Phoenix Private Flights is a commercial platform and brand dedicated to the intermediation, coordination, commercial management and assistance in the booking of private flights, executive flights, charter flights, on-demand flights, private air transfers and related ancillary services.

Phoenix Private Flights acts as a commercial intermediary, advisor, coordinator or air charter broker, connecting clients interested in private aviation services with air operators, aircraft owners, aviation companies, certified operators, logistics providers, handling companies, airports, FBOs, travel agents and other independent third parties.

Unless expressly stated in writing, Phoenix Private Flights is not an airline, is not an aircraft operator, does not operate its own aircraft, does not directly provide air transportation services and does not exercise direct operational control over aircraft, crews, permits, routes, schedules, maintenance, authorizations or technical flight decisions.

The flight operation shall be performed exclusively by the duly authorized air operator, aircraft operator or provider in accordance with the applicable regulations of the relevant jurisdiction.

2Scope of Services

The services offered by Phoenix Private Flights may include, among others:

  • Requesting and managing private flight quotes.
  • Searching for available aircraft.
  • Coordination with air operators.
  • Presentation of flight alternatives.
  • Assistance in aircraft selection.
  • Coordination of itineraries and availability.
  • Coordination of airport services, handling, documentation, catering, permits, slots, FBOs and other ancillary services.
  • Commercial support before, during and after the booking process.

The availability of each service will depend on the requested route, date, number of passengers, type of aircraft, applicable regulations, passenger documentation, operator availability, weather conditions, airport restrictions, governmental authorizations, slots, overflight permits, operating hours, immigration, customs, health, security and any other operational or legal requirements.

3Nature of Quotes

Any quote issued by Phoenix Private Flights is informative, estimated and subject to availability, unless expressly stated otherwise in writing.

A quote does not constitute a confirmed reservation, final contract or guarantee of aircraft, crew, route, price, airport, schedule or service availability.

Quotes may vary due to multiple factors, including but not limited to aircraft availability, date or schedule changes, route or airport changes, number of passengers, aircraft waiting time, crew overnight costs, fuel, airport fees, handling, operating permits, slots, aircraft repositioning, immigration or customs restrictions, weather, exchange-rate variations, operator changes, additional services or special client requirements.

A reservation will only be considered confirmed once the client has formally accepted the proposal, paid the required amounts and received written confirmation from Phoenix Private Flights or the relevant operator.

4Reservation Confirmation

To confirm a reservation, Phoenix Private Flights may request written acceptance of the quote, full passenger details, valid travel documents, contact information, signed forms or authorizations, full or partial payment, acceptance of operator-specific conditions and information regarding luggage, pets, minors, special assistance or other requirements.

Failure to provide the required information or documentation in due time may prevent confirmation of the flight, cause delays, additional costs or cancellation of the operation.

Phoenix Private Flights shall not be liable when a flight cannot be operated because the client failed to provide the necessary information on time or provided incomplete, incorrect, false, expired or insufficient documentation.

5Prices, Fees and Currency

Prices may be expressed in United States dollars, Argentine pesos or any other currency indicated in the quote.

Depending on each case, the final price may include or exclude flight cost, aircraft repositioning, waiting time, overnight costs, airport fees, handling, catering, cleaning, permits, immigration or customs services, ground transportation, brokerage fees, applicable taxes, bank charges, administrative costs and special services.

Any item not expressly included in the quote shall be considered excluded.

In the event of exchange-rate variations, changes in third-party costs, operational changes, regulatory changes, additional taxes or client-requested modifications, Phoenix Private Flights may update the price before final confirmation or even after confirmation when such changes depend on third parties or circumstances beyond its control.

6Payments

Payments must be made through the methods indicated by Phoenix Private Flights for each operation.

A reservation may be subject to a deposit, advance payment, partial payment or full payment before the flight.

Until the required payment has been effectively credited, Phoenix Private Flights and/or the operator may consider the reservation unconfirmed.

All costs arising from bank transfers, commissions, taxes, withholdings, administrative expenses or financial intermediary charges shall be borne by the client unless expressly agreed otherwise.

Phoenix Private Flights may reject or suspend an operation if it detects uncredited payments, insufficient funds, suspicious transactions, documentary inconsistencies, contractual breaches or any situation that may affect the legal, financial or operational security of the booking.

7Cancellations by the Client

Cancellations requested by the client shall be subject to the particular conditions of each operator, aircraft, route and quote.

Depending on the case, cancellation may generate partial or total charges, including loss of deposit, administrative fees, operator penalties, repositioning costs, crew costs, permits already processed, non-refundable fees, contracted handling, catering, ground services, brokerage fees, bank costs and any incurred expense.

Unless expressly agreed in writing, Phoenix Private Flights does not guarantee full refunds for cancellations made by the client.

Any cancellation request must be made in writing and shall be deemed received only when Phoenix Private Flights confirms receipt.

8Changes Requested by the Client

Any modification requested by the client, including changes to date, schedule, airport, route, number of passengers, luggage, additional services or flight conditions, shall be subject to availability and operator approval.

Changes may generate additional costs. Phoenix Private Flights does not guarantee that requested changes can be accepted, even if requested in advance.

If the change is not possible, the original reservation conditions or applicable penalties shall apply.

9Operational Cancellations, Delays or Modifications

The client acknowledges and accepts that private flights are subject to operational, technical, regulatory, meteorological and safety factors that may cause delays, itinerary changes, aircraft changes, airport changes, rescheduling or cancellation.

  • Adverse weather conditions.
  • Air traffic restrictions.
  • Lack of slots.
  • Airport closures or runway restrictions.
  • Technical failures or unscheduled maintenance.
  • Aircraft or crew unavailability.
  • Crew duty-time limitations.
  • Permit delays.
  • Immigration, customs or health restrictions.
  • Decisions by aviation authorities.
  • Operational safety issues.
  • Force majeure events.
  • Decisions by the aircraft commander.

Operational safety shall always prevail over any commercial interest, schedule or client commitment.

Phoenix Private Flights shall not be liable for damages, losses, loss of profit, lost opportunities, missed connections, cancelled events, hotel reservations or personal, commercial or professional commitments affected by delays, cancellations or modifications caused by circumstances beyond its control.

10Authority of the Commander and Operator

The client accepts that the aircraft commander and the air operator have final authority over every decision related to safety, operation, boarding, disembarkation, route, load, luggage, passengers, stops, weather conditions, delays, cancellations or any technical aspect of the flight.

Phoenix Private Flights cannot require or guarantee the performance of an operation when the operator, commander or competent authority determines that it is unsafe, illegal or unfeasible.

11Passenger Documentation

It is the exclusive responsibility of the client and each passenger to hold valid and sufficient documentation for the trip.

  • Identity document.
  • Passport.
  • Visas and entry permits.
  • Immigration authorizations.
  • Authorizations for minors.
  • Health certificates.
  • Pet documentation.
  • Customs declarations.
  • Special permits.
  • Any documentation required by the origin, destination or transit country.

Phoenix Private Flights may assist with general information, but does not guarantee the sufficiency, validity or acceptance of documentation by immigration, customs, health or airport authorities.

Denied boarding, entry, transit or stay due to insufficient, expired, incorrect or rejected documentation shall be the sole responsibility of the passenger or client.

12Minor Passengers

When minors travel, the client must inform Phoenix Private Flights in advance and provide all documentation required by applicable regulations.

Phoenix Private Flights and/or the operator may require travel authorizations, parent or guardian details, additional documentation or specific forms. Lack of such documentation may prevent boarding without refund rights.

13Luggage

Permitted luggage depends on aircraft type, number of passengers, route, weight, volume, balance, technical limitations and applicable regulations.

The client must inform in advance the quantity, weight and type of luggage. Phoenix Private Flights does not guarantee that all luggage can be transported if it exceeds aircraft operational limits or was not previously reported.

The operator may reject luggage for safety, weight, volume, content, regulatory or operational reasons.

14Prohibited or Restricted Items

It is forbidden to transport illegal, dangerous, explosive or flammable items, weapons, controlled substances, hazardous materials, undeclared goods or any item prohibited by applicable regulations.

The client is responsible for declaring any special or restricted item before the flight. Phoenix Private Flights and/or the operator may reject the transport of any item considered risky, illegal, undeclared or incompatible with the operation.

The client shall be responsible for any penalty, damage, cost, delay or consequence arising from the transport or attempted transport of prohibited, restricted or undeclared items.

15Pets

Pet transportation is subject to prior operator approval, aircraft type, route, health documentation, origin, destination or transit country requirements and the particular conditions of each operation.

The client must inform in advance the pet species, breed, size, weight and documentation. Phoenix Private Flights does not guarantee pet acceptance on all flights.

Lack of health documentation, permits or prior approval may prevent boarding of the pet without refund rights.

16Passenger Conduct

Passengers must maintain appropriate and respectful conduct compatible with flight safety, crew, aircraft, airports and third parties.

The operator or commander may deny boarding or disembark any passenger who is under the influence of alcohol or drugs, behaves aggressively or inappropriately, endangers flight safety, refuses to follow crew instructions, damages the aircraft, breaches applicable regulations, presents insufficient documentation or attempts to carry prohibited items.

In such cases, the client shall not be entitled to a refund and shall be responsible for damages, costs or penalties caused.

17Additional Services

Phoenix Private Flights may coordinate additional services such as ground transportation, hotels, catering, VIP assistance, private lounges, security, airport services, FBOs, special permits or other ancillary services.

Such services are provided by independent third parties. Phoenix Private Flights shall not be liable for failures, delays, errors, damages, accidents, losses, cancellations or modifications attributable to such third parties, although it may reasonably assist the client in managing the corresponding claim.

18Intermediation and Third-Party Providers

The client acknowledges that Phoenix Private Flights acts as an intermediary between the client and one or more third-party providers.

Air operators, aircraft owners, FBOs, handling companies, airports, ground transportation companies, catering providers and other third parties act independently.

Phoenix Private Flights does not directly control the effective provision of those services and does not assume liability for acts, omissions, breaches, negligence, delays, cancellations, errors or decisions by third parties. Operational responsibility for the flight belongs to the authorized air operator.

19Limitation of Liability

To the maximum extent permitted by applicable law, Phoenix Private Flights shall not be liable for indirect, incidental, special, punitive or consequential damages, loss of profit, loss of chance, loss of benefits, loss of business, data loss, reputational damage, missed connections, reservations, events or commitments affected by use of the website or booking of services.

Any liability of Phoenix Private Flights, where legally applicable, shall be limited to the amount actually received by Phoenix Private Flights as brokerage commission or fee for the specific operation giving rise to the claim, unless applicable law provides otherwise.

Nothing in these Terms and Conditions limits mandatory consumer rights that may apply under applicable law.

20Force Majeure

Phoenix Private Flights shall not be liable for breaches, delays, cancellations or modifications arising from force majeure, acts of God or circumstances beyond its reasonable control.

For proper service provision, Phoenix Private Flights may share client and passenger information with air operators, crews, airports, FBOs, handling companies, immigration, customs and aviation authorities, catering providers, ground transportation providers, payment processors, legal or accounting advisors and any other third parties necessary for the operation.

The user accepts that such transfer or communication of data may be necessary for coordination and execution of the requested service.

27Communications

The user authorizes Phoenix Private Flights to contact them by email, phone, WhatsApp, SMS or other digital channels provided by the user in order to answer inquiries, send quotes, coordinate services, request documentation, confirm reservations, report operational changes or send service-related communications.

The user may request to stop receiving commercial communications, without prejudice to communications necessary for ongoing operations or compliance with legal obligations.

28Suspicious Payments, Fraud Prevention and Legal Compliance

Phoenix Private Flights may request additional information, supporting documentation or verifications when it deems necessary to prevent fraud, money laundering, terrorism financing, misuse of the service, identity theft or regulatory breach.

The client accepts that technical and operational decisions may modify or cancel a flight without this constituting a breach by Phoenix Private Flights.

33Client Responsibility

The client shall be responsible for providing true and complete information, paying agreed amounts, submitting documentation on time, informing special requirements, luggage, minors or pets, complying with operator and crew instructions, complying with immigration, customs, health and airport regulations, responding for damages caused by the client or passengers and paying additional costs generated by changes, delays or breaches attributable to the client or passengers.

34Damage to Aircraft or Third Parties

The client shall be responsible for any damage caused by the client, companions, guests, employees, representatives, minors, pets or luggage to the aircraft, crew, airport facilities, vehicles, third-party property or providers.

Phoenix Private Flights may claim reimbursement of any cost, repair, penalty, compensation or expense arising from such damages.

35Aviation Law and Competent Authorities

Every air operation shall be subject to applicable aviation, immigration, customs, health, tax and security regulations in each jurisdiction.

The client accepts that Phoenix Private Flights cannot guarantee authorizations, permits, slots, regulatory approvals, documentation acceptance or decisions by public or airport authorities.

36International Services

For international flights, the client shall be responsible for complying with entry, exit, transit, immigration, customs, health, visa, special permit, minor documentation, pet, luggage and any other applicable requirements.

Phoenix Private Flights may assist with coordination but shall not be liable for decisions by foreign authorities or denial of entry, exit or transit.

37Confidentiality

Phoenix Private Flights will seek to keep client commercial, personal and operational information confidential, except when sharing is necessary to provide the service, comply with legal obligations or respond to competent authorities.

The client also undertakes not to disclose confidential commercial information, quotes, special conditions, operator data, agreements, prices or internal documentation received from Phoenix Private Flights without prior written authorization.
